Court remands man for shooting 30-year-old to death

The Chief Magistrate of a Lagos State Magistrate's Court has ordered that a 42-year-old man, Shodipo Musiliu, be remanded in prison for allegedly killing one Okiki Bamigbose with a locally-made pistol.

The police told the court that Musiliu invaded the residence of the deceased at Tebun-Fagbemi Street, in the Alagbado area of Lagos around 11.50pm on September 23, 2013.

The accused, armed with a gun, had reportedly fired at Bamigbose, killing him on the spot.

The prosecutor, Inspector Etim Ekankuk, told the court that a relative of the deceased, one Muniru Bamigbose, reported the matter at the Ijaiye Police Station.

He said, "Muniru reported the matter on September 23. Through investigation, the accused was arrested with exhibits. Preliminary investigation revealed that he was shot dead. We later transferred the matter to the Homicide Section, Panti, Lagos."

Ekankuk later filed an application for the remand of the accused in line with Section 264(1) of the Administration of Criminal Justice, Lagos State.

It was not clear what led to the attack on the victim, but the police said the accused on interrogation, admitted killing Bamigbose and that there were witnesses.

The defence counsel, Spurgeon Ataene, however urged the court to disregard the application for remand.

He said, "It is my submission that my Lord may not understand this matter if she does not conduct a preliminary enquiry and hear from the investigating police officer. And if she is not satisfied, she may grant bail. It is not right to remand persons just based on the whims and caprices of the police."

The Chief Magistrate, Ms. Demi Ajayi, in her ruling, observed that the country's magistrate's court had no power to grant bail in an offence that takes capital punishment.

She said, "The court does not have the power to grant bail. The decision has been left to the Director of Public Prosecution. The prosecution having shown sufficient reason for a remand, the court does not need to make any enquiry."

Ajayi ordered that the accused be remanded in prison for a minimum of 30 days, pending the DPP's advice.
